The parties agree to meet in OCTOBER, and Eyetech may very well show up, being part of the defendant.
If there's a trial, it will be approximately 10 days long! Hyperion wants to cap at 10 witnesses and Amiga Inc. wants more than that many! Wouldn't that strain Amiga Inc. Del.'s organization to the braking point, that many people taking time off work? Oh wait, not all of the 12 or so people that appear are their employees.

October +45 days maximum to SET a date for trial. That would be approximately end of November, based on Oct. 15, say. Trial may be set to be in Jan. 2009. ~10 days of trial? Verdict by Feb.-Mar. 2009.
There was even mention of a judge just outright declaring a verdict on all the documents entered, based on "as-is" i.e. their current state.

I just read CodeSmith's comment 107 on AW.N and relized something. It will NOT end in October.

The winner is supposed to also get the loser to pay their law bills, right? Hyperion DOES NOT DESERVE to pay ANY LAW FEES incurred, whatsoever. And Amiga Inc. Del. boldly went and spent the farm on their cadre of vultures to no avail. Hahahahahahahaha!!!!!!!
Amiga Inc. will hopefully be getting what it deserves, mostly, crushed in court that is. They've been the cause of much misery and deserve even much more in the way of bad things happening. I hope there's eventually an investigation into their wheelings and dealings.
SOME investor at some point should be instigating a lawsuit against the people involved. Then we may finally know what it's all been about.

So, to sum up everything in more undestandable language.
1. There is going to be a conference between Amiga Inc. and Hyperion on which Eyetech will appear. The conference will be held in October and will be conducted by the judge Kelley Arnold.
2. Up to 45 days after the conference (judical settlement) there will be a jury trial which will take up to 10 days.
