A ruling has just been passed that sets a precedent.
They are using that ruling in their attack on Hyperion.

This Farce is set to continue.

Well, I must say; this forum is certainly living up to it's title!

Is this *Amiga* related? In a way; YES!

CLERK'S JUDGMENT That for the reasons stated in the Court's Memorandum and Order dated September 3, 2008, defendants motions to dismiss are granted; accordingly, each case is closed and all pending motions denied as moot. (Signed by J. Michael McMahon, clerk on 9/24/08) (Attachments: # 1 notice of right to appeal)(ml) (Entered: 09/24/2008)

I.A.N.A.L.!!!!!!!!!!!!!!!!!!!

(I think that's the first time I've ever said that but it was widely speculated, I'm certain! )

BUT, I think Hyperion Entertainment VOF has W O N the case!!!!!!!!!!!!!!!!!!!

Look at what it says!
"defendants motions to dismiss are granted"
The defendants are Hyperion Entertainment!

It continues....
"accordingly, each case is closed and all pending motions denied as moot."

Seems to be an open and shut case??

Although:
"Attachments: # 1 notice of right to appeal"
is maintained, as we all thought would be an avenue left open.

Atheist, very reservedly, very, very anxious!!!!!

Relax, it might not even be related to the ainc/hyp case. The docket RSS feed has been a bit weird in the past.
