This is the result of an unfortunate administrative mishap by a third party and is in the process of being addressed/cleared up.

This may take a while as everything takes a while in Belgium whilst it comes to administrative and judicial matters.

Saw that a bit late.

It doesn't have to mean much really. I've seen around here about some guy being tried to put down many times. Each time he has fixed up and said it was misunderstandings. So no worry yet. Besides i don't think acube and a-eon would like to see AmigaOs be gone/lost???

Ben has given all betatasters permission to talk about this freely.

Due to an administrative cock-up Hyperion weren't informormed about it until after the hearing. Now they have to appeal against the descision which will not be a problem, it will just take time. Development and Betatesting is going on as usual. No popcorn is required, don't panic and carry on as usual.

Beta-testing of new AmigaOS4 stuff is continuing as usual.

Mr Hermans has given beta-testers permission to repeat what he has said on the matter. I'm mostly just copy & pasting what he's said:

In Belgium anybody can file a bankruptcy claim even for 150 EUR or so. It is a common pressure tactic used by parties who do not wish go to the usual court process because most companies will pay rather than go through the motions of fighting off a bankruptcy claim.

It is an abuse of procedure, but in Hyperion's case matters came this far because the company which handles their administrative seat did not hand over the writ of summons in time for them to know about the claim.

They could easily have fended off the bankruptcy claim, but now they need to overturn the judgement. As with many legal matters, this may take some time. They cannot even put out an official statement until some legal matters have been dealt with. Hence the comparative silence from Hyperion so far.

In the Czech Republic, incurred insolvency (i.e. a situation when a company cannot pay its liabilities because some other company didn't pay them) is extremely common. As a result, many companies find themselves waiting for invoiced payments and, therefore, effectively insolvent from time to time. Taking them to the bankruptcy court for not paying you because they're likely being owed by somebody else is a popular move to fight your competition around here.
