Gloves are off? thats a major understatment. As far as I can tell Hyperion own the rights to the term AmigaOS... Hopefully the court will agree.

I am guessing Hyperion could get some serious payments out of Amiga Inc for this... perhaps even Hyperion could take control ???

im afraid there isnt a football forum, so in the trash it goes ;)

back on topic - arguments are being made before the judge at the end of the month aparently, so after that we will have a clearer picture of things.

also, how can hyperion say amiga didnt have an upgraded version of os4 available 6 months after it was available, if hyperion have not given the code to it. also wasnt there a point where hyperion said it was released december last year (not when pre-release 1 came out)

it seems to me all this delaying is what hyperion wanted from the start, so that they can go for the big secured money - the 1.5million they state they would require to sort everything out.

If I understand the argument correctly, Hyperion would only deliver the source code once the $25,000 "buy-in" option would be executed, which it never was (according to Hyperion).

Best would be if they'd smash back AInc, be able to keep OS4
and drop the whole irritating 25K buy-back thingie.

Heck, when it comes to money for Hyperion, i'd throw in a
month salary to back them up, promise (as long as it is an
"official" step and i know it would be put into further
OS4 development)

i think the ideal thing is for amiga.inc to get back everything, and then sell it to someone who gives a crap :) someone new who hasnt been tainted by the amiga markets.

What do you mean, let this thread go? The lawsuit is a great happening for all armchair lawyers.
It's an opportunity to voice an opinion on it. Of course everybody might be wrong in the end.
But at the moment, I don't believe even the judges know what to think about it, because they are still trying to sort out this whole mess.
And it's a big mess and has a huge impact on the future of OS4. So why not talk about it, even if we are just armchair experts?

I don't see a battle here. Yes, there are some people who are supporting Amiga, Inc and others who are supporting Hyperion, but I see no problem when they are exchanging opinions and there is no fighting.
Everybody knows that only the court is able to resolve it. Whater that means...resolve it...

Hi derfs,

I do believe it kept saying "classic", as though, Amiga Inc. were supposed to have released another version of AOS3.1/3.5/3.9 for the OCS/ECS/AGA 680x0 series of machines within 6 months of AOS4.0.

I do not question Hyperion's integrity in the matter in the least.


They delivered a product that is most excellent, and will ONLY get better.....



It ONLY needs a wider library of more feature filled SW, and then, the SKY'S the limit!!!!
